Obama on Supreme Court nominees

That's quite a litmus test, Mr. President:

<!-quote-!>quote:
During Friday's White House press briefing:

- "Now, the process of selecting someone to replace Justice (David) Souter is among my most serious responsibilities as president, so I will seek somebody with a sharp and independent mind and a record of excellence and integrity. I will seek someone who understands that justice isn't about some abstract legal theory or footnote in a casebook; it is also about how our laws affect the daily realities of people's lives, whether they can make a living and care for their families, whether they feel safe in their homes and welcome in their own nation. I view that quality of empathy, of understanding and identifying with people's hopes and struggles, as an essential ingredient for arriving at just decisions and outcomes. I will seek somebody who is dedicated to the rule of law, who honors our constitutional traditions, who respects the integrity of the judicial process and the appropriate limits of the judicial role. I will seek somebody who shares my respect for constitutional values on which this nation was founded and who brings a thoughtful understanding of how to apply them in our time."

<!-/quote-!>

http://apnews.myway.com/article/20090501/D97TM46O0 .html

You'd like the bar set a little lower? Is that how you taught your children, don't aim too high, just get by?

Expecting the best is a far better way of guaranteeing that we will get the best available.
(Which will, of course, be a woman).

Justice isn't always dealt out by people of the above discription. Be careful what you ask for, Elaine, is my point. You do want a just person to be a judge? That's all I want.

Is Obama using ‘code’ for activist judge?

http://www.lasvegassun.com/news/2009/may/03/hatch- is-obama-using-code-for-activist-judge/

<!-quote-!>quote:
Hatch: Is Obama using ‘code’ for activist judge?
The Associated Press

Sun, May 3, 2009 (6:51 a.m.)

A senior Republican on the Senate committee that will consider President Barack Obama's Supreme Court nominee says he's worried the president might pick a judicial activist instead of someone who bases decisions on the law.

Sen. Orrin Hatch of Utah says Obama's comment last week about naming a justice who understands Americans' problems and has empathy for people is "code" for putting in place a person who legislates from the bench.

Hatch says he realizes the president will choose a more liberal person for the opening created by Justice David Souter's retirement. Hatch, a top Republican on the Senate Judiciary Committee, says he expects the nominee to favor abortion rights.

Hatch spoke Sunday on ABC's "This Week."
<!-/quote-!>

Hatch has it right, we don't want a social engineer we want a judge that understands law. After all it is not a Social Worker we are looking for, right???
